August newsletter

Hugh Jones Solicitors who are Court of Protection Specialists came to the July HALDS meeting to talk to us about Wills & Trust Funds and also Deputyships.

Wills & Trust Funds – If you have a son or daughter with a disability it is unwise to   leave money directly to them for 2 reasons, firstly they may not be able to handle the responsibility of looking after an inheritance sensibly and secondly, receiving money outright is likely to affect their right to claim means tested benefits or statutory services.  These problems can be overcome by setting up a special trust within your Will to make sure that your child can benefit from their inheritance without losing out on valuable benefits.   If you would like to speak to a member of Hughs team about setting up a Will & Trust fund, please let me know by 4th August, as I will arrange a day when someone can come to Runcorn/Widnes  and visit you in your home.  I will ask a price for setting up a Will & Trust fund and let you know the cost involved.

Deputyship – An application has to be made to the Court of Protection for a deputyship and it is in 2 parts, Financial and Welfare Decisions.  A deputyship is required for example, if your cared for has a bank account in their name and also your name to enable you to handle the account, but say you are ill or pass away suddenly, this causes a problem with their account, so a deputyship could be taken out with a siblling or other family member to enable them to sort out the finances of your cared for.    This is also in the place of Welfare Decisions, in case you are ever unable to make decisions for them.   As these deputyships would be raised in your cared for names, Hugh advises the cost will be minimum as they would get help with the costs.  If you are interested in setting up a deputyship,  please let me know, I will then arrange another meeting with Hugh to come along with the Court of Protection forms and he will advise on how to fill them in.  Please let me know by 4th August, if you would like to partake in this discussion. I hope I have explained this ok, if not you can go on the website Deputyship Court of protection and this should explain better.  The only thing you will need is a letter from your doctor advising your cared for has a lack of capacity to manage their affairs.

Hugh has also advised he will also check members existing Wills if you would like to get it checked out by him.  A number of us have had Discretionary trusts funds already set up by Hugh and would highly recommend him.  Hugh has in fact been named by Chambers 2015 in the ‘Ranked Lawyer’ list as a Band 1 ‘Leader in the field’ in Court Protection Propery and affairs work – one of the only two practitioners to achieve this accolade nationally and the only one in the North of England.

Repeat Prescriptions – Important changes

From 4th September Runcorn practices will only accept repeat prescriptions from you, your carer or a family member/friend NOT from your pharmacy.

Pharmacies that deliver medications to your door will continue to do so.

At this time these changes do not affect patients who currently receive their medication in blister packs or prescriptions ordered via appliance contractors e.g. for specialist feeds, stoma and continence appliances.

These changes are being introduced for a number of reasons:

  • Ordering your repeat prescription direct allows direct communication about the medicines that you do and do not use
  • Under the old system some patients reported that they began to build up a large stock of unused medication.  This means that a lot of this medication could not be stored safely or be used within the ‘use by’ date.
  • Changing how you order your repeat prescriptions can help reduce medicines waste.
  • I am looking at starting a Caring with Confidence course on 14th Sept for 7 weeks at Mencap Acorn Centre, Laburnum Grove, Runcorn  10am – 1pm . Let me know if interested by 4th August.
